TERMS OF SERVICE
GUIDELINES IN PLACE TO ENSURE PROPER EXPECTATIONS & UNDERSTANDING

By ordering services from The Mix Media, the client agrees to the following Service Agreement for photography, videography, and social media content creation needs. These guidelines are in place to ensure a smooth and efficient service experience for both The Mix Media and our valued clients.

APPOINTMENT REQUESTS:

  • To ensure the best results, please ensure the property is fully prepared before the scheduled appointment.
  • By confirming your appointment, you agree that the home will be photo and/or video ready at the scheduled date and time. It is the client’s responsibility to coordinate with homeowners, agents, or property managers to ensure readiness before our arrival.
  • While The Mix Media strives to honor requested appointment times, we reserve the right to adjust schedules as needed for logistical reasons.
  • Any property that is not photo and/or video ready at the scheduled time will be subject to a $75 same-day rescheduling or cancellation fee.
  • For liability reasons, The Mix Media does not handle property preparation, such as cleaning, staging, or moving furniture.

TIME, CANCELLATIONS, AND WEATHER POLICY:

  • Appointments may be rescheduled or canceled without penalty up to 24 hours before the scheduled time.
  • Cancellations or reschedules within 24 hours of the appointment will result in a $75 fee.
  • Weather-related rescheduling is permitted at the client’s discretion, but drone services cannot be performed in rain or hazardous wind conditions.
  • If rescheduling due to weather, we ask clients to notify us at least 24 hours in advance.
  • Premium packages may require up to two hours for completion, with larger properties potentially requiring additional time.
  • Standard turnaround time is next-business-day delivery for photos and 1-5 business days for videos.
  • Next-day video rush delivery is available for a $200 fee, subject to availability.

REFUNDS:

  • All services provided by The Mix Media are nonrefundable. If you are dissatisfied with your media, please contact us directly to discuss potential solutions.

TRAVEL & ADDITIONAL SQUARE FOOTAGE COSTS:

  • The Mix Media services the San Francisco Bay Area and surrounding communities. A travel fee will apply for locations beyond our primary service area.
  • Additional square footage costs will be outlined at the time of booking, ensuring transparency for larger properties requiring extended shooting time.

VIDEO POST-EDITING:

  • Standard photo delivery is next-day by the end of the business day. Additional edits (e.g., advanced Photoshop requests) are subject to an $15 per-photo editing fee.
  • Standard video walkthroughs include property tour and royalty-free music. Any requested format deviations must be specified at booking.
  • Any additional edits requested after final delivery will incur a $50 minimum re-editing fee.

LIMITED LICENSING RELEASE:

  • The Mix Media provides a licensing agreement for the use of photos and videos for real estate marketing purposes only. The client does not own the media outright but is granted a license for specific use.
  • Media may not be transferred to third parties (e.g., builders, stagers, designers) without prior authorization and licensing agreements.
  • Copyright remains with The Mix Media, and images/videos may not be altered beyond minor resizing without permission.
  • Rebranding of media for new agents or relisted properties is available for an additional fee.

PAYMENT & LATE FEES:

  • Full payment is due before media delivery. Galleries will be unlocked for download upon receipt of payment.
  • Late payments are subject to a $25 per week late fee at our discretion.
  • Payments overdue by one month are subject to a $100 or 10% late fee, whichever is greater.
  • If payment remains outstanding for more than four weeks, the brokerage and associated parties may be contacted regarding the outstanding balance.

PHOTO & VIDEO USAGE:

  • Clients may use delivered photos and videos for listing promotions on MLS, social media, and other real estate marketing channels.
  • Copyright remains with The Mix Media, and media may not be transferred or resold without authorization.

WORK PRODUCT OWNERSHIP:

  • The Mix Media retains ownership of all photographs, videos, and other media created.
  • We reserve the right to use media for advertising, portfolio display, and promotional purposes.
  • Unauthorized use of The Mix Media’s content is a violation of copyright law and may result in legal action.

PROPERTY OWNER APPROVAL:

  • It is the client’s responsibility to obtain property owner permission prior to booking services.
  • The Mix Media respects privacy and will focus footage exclusively on the property in question.

SEVERABILITY:

  • If any provision of this agreement is found invalid, the remaining terms will remain in effect.

By booking services with The Mix Media, you acknowledge and agree to the above Terms of Service.
